What should I do if I slip and fall or am otherwise injured on someone's premises?
Report the incident. Ask for a copy of the slip and fall report taken by any employee or other responsible person at the scene. While they are not required to give you a copy of a premises liability report, many businesses and establishments will do so if you ask. Have a witness present when you are making the report to insure that the person taking the report accurately records your statements.

Identify any and all witnesses. In a premises liability case, witnesses are often the only means of proving how an accident occurred. Unlike auto accidents where the damage to the vehicles and their position provide physical evidence of how the accident occurred, in a premises case, if you don't have witnesses it may be your word against the defendants. For example, they may claim they posted warning signs when in fact they didn't, or they may claim you never fell at all.

If you slipped in something, get a sample if possible. This can make a tremendous difference later on.

Take pictures of the area, what injured you (e.g. what you slipped in, or what fell on you) and any warnings that were posted in the area. As with witnesses, without physical evidence such as photographs it can be quite difficult for your San Diego slip and fall attorney to prove your premises liability claim.
