Workers' Compensation

San Diego Workers' Comp Attorney Case Examples

In a case which concluded in a confidential settlement, our San Diego workers' comp attorney represented a roofing worker who fell from the roof of a one-story residence. His fall was caused by a scrap of wire “lath” left on the roof by the employees of a subcontractor. This wire was protruding from a pile of roof tiles, stuck in our client's pant-leg and tripped him, causing him to fall from the roof. Unfortunately, our client's neck was broken in the fall and he was left quadriplegic.

While he was eligible for workers' compensation through his own employer subcontractor (the roofers), he also had a third party personal injury claim because the accident was caused by the negligence of another subcontractor's employees. As any competent construction worker knows one should clean up their work area when finished, this is even more important when working on a roof.Their failure to do so will have an impact on every day of our client's life. It was very satisfying for our workers' comp attorney to know our efforts made life easier for him and his family.

This is why we caution everyone who thinks their injury claim falls under workers' compensation to consult with a workers' comp attorney first – you may have a claim against a responsible third party in addition to a traditional workers' compensation claim. The worker's compensation third party recovery is typically much higher than the workers' compensation recovery alone, particularly in California, which has some of the highest compensation insurance rates and the lowest payouts as well.
